The objective of the text is to propose an interpretation of Hume's works that allows another way of refusing contractualism, different from the "official" refusal, and which is based (the new one) on the concept of artifice, which is extremely different from the artifice created by the contractualists, whose opposition the tradition of commentators of Humean political philosophy, generally, do not refer to, when it is the case of refusing contractualism.

O objetivo do presente artigo é discutir os vínculos existentes entre a teoria humeana e o Utilitarismo. Nesse contexto, mencionando a divergência existente entre os comentadores de Hume a respeito de seu lugar diante do Utilitarismo, conclui-se que, embora o caráter descritivo de fato predomine na teoria humeana, ela não é inteiramente desprovida de pretensão prescritiva. Será ainda necessário discutir em que consiste essa pretensão, isto é, o que ela busca prescrever.

This paper puts forward an interpretation of Hume's work which suggests a new means of refuting contractualism. This interpretation differs from the 'official' refutation, in that it is based on a concept of artifice which is significantly different from the concept of artifice propounded by the contractualists. This difference is not generally noticed in traditional commentary on Humean political philosophy when it deals with the refutation of contractualism.

O presente artigo pretende discorrer sobre o conceito de natureza possibilitado pela ontologia de Heidegger, que busca no pensamento grego seu sentido mais originário, e a crítica do filósofo ao conceito proporcionado pela metafísica clássica que teria provocado distopias na relação entre o homem e a natureza ao objetivá-la. Tal relação de domínio, além de evidenciar a necessidade de uma reflexão sobre o antropocentrismo, também e, por consequência disso, desvela-se através da crise ambiental vivida hoje por nós. Dessa forma, Heidegger (...) encontra tal sentido originário na palavra physis, o qual discuto nas páginas seguintes suas nuances a partir do que foi levantado pela obra do filósofo. Busca-se assim encontrar um sentido autêntico de natureza, antes do que foi assimilado pela tradição metafísica e desencoberto pelo ser humano como uma reserva ao seu dispor. (shrink)

Starting from the analysis of a phenomenological reading of the parable of the Good Samaritan and arriving at the idea of the World Person in Chiara Lubich, this article will discuss two topics: union in difference and the model of the neighbor in the Gospel. For Christians this is the confirmation that the meeting with the stranger is possible. Christ founded a community that co-exists with the stranger. It is within this path that the intuition the figure of the World (...) Person in Chiara Lubich arises. In the tension between interpretation and Truth, Lubich puts the question: was there anyone that went through the trial of doubt about the Truth, but has been able to create a new world? She says that was Jesus Forsaken, who opens up the possibility of differentiation without exclusion. (shrink)

A Crítica da faculdade de julgar foi recebida com entusiasmo pelos filósofos do idealismo alemão. No caso de Friedrich Schelling, as duas partes da obra foram influentes, de modo que não só a estética kantiana, mas também a teleologia foi marcante em sua trajetória filosófica. Observaremos como o filósofo de Leonberg acolhe, na Introdução às Ideias para uma filosofia da natureza, a noção kantiana de organismo como dotado de autocausalidade, mas pensa-a nos quadros de uma filosofia pós-kantiana, buscando prescindir das (...) noções de juízo reflexionante e também da ideia de “natureza como arte” para se pensar o organismo. Como Schelling vincula essa noção com a proposta de se pensar a unidade entre natureza e espírito a partir do próprio sujeito, e não de algo exterior a ele? Como Kant reagiria a tal proposta? The Critique of Judgment was enthusiastically received by the German Idealists. In the case of Friedrich Schelling, both divisions of the work were influent, thus resulting that not only Kantian aesthetics, but also the teleology was a landmark in his philosophical itinerary. We attempt to observe how the philosopher of Leonberg receives, in the Introduction to the Ideas for a Philosophy of Nature, the Kantian conception of organism as endowed with self-causality, but at the same time thinks it within the frame of a post-Kantian philosophy, leaving aside the reflective judgment and also the idea of nature as a product of art in order to think the organism. How does Schelling connect this notion with the proposal to think the unity between nature and spirit based on the own subject, and not on something external to it? Examinaremos como surge, na Kritik der Urteilskraft, a discussão acerca do belo como símbolo do bem moral, a saber: na Dialética da faculdade de julgar estética, na segunda divisão da Crítica da faculdade de julgar estética. Traçaremos paralelo entre a antinomia do gosto e sua resolução com a antinomia da razão prática, tal como apresentada na Kritik der praktischen Vernunft. Pretendemos mostrar como ambas fazem recurso à distinção entre fenômenos e coisas em si como fonte de sua resolução. Discutiremos, em (...) seguida, como Kant apresenta a necessidade de sensibilização de ideias estéticas, e como o simbolismo permite tal feito. A finalidade explícita na arquitetura e ênfase na utilidade, no aspecto de uma aplicação prática, intrigou filósofos alemães como Immanuel Kant e August Schlegel. O entrelaçamento entre beleza e finalidade na arquitetura fora notado cedo por Marco Vitrúvio Polião, que aponta utilidade, solidez e beleza como características fundamentais da obra arquitetônica. Segundo Guyer, a partir de Kant, o pensamento filosófico sobre a arquitetura começa a apresentar um distanciamento em relação a Vitrúvio, de modo que, mesmo sem total renúncia à tríade (...) vitruviana no pensamento de Kant, este defende ser a característica principal da arquitetura representar ideias estéticas. A tese de Guyer aponta o desenvolvimento desse ponto de Kant em Schelling, Hegel e Schopenhauer, todavia com uma lacuna: August Schlegel, fundador do primeiro sistema de belas artes com sua Kunstlehre. Buscaremos aprofundar como a tese de Guyer não só é válida, mas ganha mais solidez no caso de August Schlegel e do papel que este confere à imaginação na arquitetura. Após a indicação de elementos vitruvianos e pós-vitruvianos em Kant e Schlegel, indicaremos as divergências entre ambos na apreciação da arquitetura, a partir de suas articulações entre arquitetura e finalidade. This book is a large-scale historical reconstruction of liberal legalism, from its inception in the mid-nineteenth century, the moment in which the jurists forged the alliance between political liberalism and legal expertise embodied in classical private law doctrine, to the contemporary anxiety about the possibility of both a liberal solution to the problem of political justification and of law as a respectable form of expert knowledge. Each stage in the history is a moment of synthesis between a substantive and a (...) methodological idea. The former is the liberal political theory of the period, purporting to provide a solution to the problem of political justification. The latter is a conception of legal method or science, supposedly vindicating the access of the expert to the political choices embodied in the law. Thus, each moment in the history of liberal legalism integrates a political theory with a jurisprudential conception. Although it reaches the unsettling conclusion that liberal legalism has largely failed by its own standards, the book urges us to avoid quietism, skepticism or cynicism, in the hope that a deeper understanding of the fragility of our values and institutions inspires a more thoughtful, broadminded and nurtured citizenship. Disagreement on law’s relationship to morality has long been driven by disagreement about our ordinary concept. Until recently, however, there had been no systematic investigation of lay intuitions. In this paper, we advance this nascent effort. Across two studies (N = 697), our findings reveal that most people consider law to be more than a matter of political circumstance alone. Contrary to the expectations of most contemporary philosophers, morality (both substantive and procedural) emerges as a key influence on judgments of (...) legal validity: many people say that conduct prohibited by immoral statutes is not truly illegal, and that immoral conduct which was never explicitly prohibited is truly illegal. This suggests that people often treat law as a dual character concept that, like the concepts of scientist or of artist, features autonomous concrete and abstract dimensions. (shrink)

This article explores the ways in which suspects attempt to make putative victims/complainants at least partially responsible for the incidents for which they are investigated, transforming themselves into the victim and the other into the perpetrator. Drawing upon conversation analysis, I examine audio-recorded police interviews for low-level crimes in England and in which suspects have constructed what I refer as counter-denunciations. I argue that suspects accomplish these counter-denunciations through discursive practices that involve, for example (a) contrasting the complainant’s actions with (...) their own innocent conduct; (b) historicizing the event being investigated; and (c) discrediting the complainant’s character—stigmatizing. These practices have in common the suspects’ reliance on the relational and contextual character of the categories ‘offender’ and ‘victim’. (shrink)

O objetivo deste artigo é refletir sobre o modo como as lutas locais e suas movimentações em torno do discurso dos direitos humanos podem ser alçadas à condição de ação política. Trata-se da tentativa de ampliar o conceito de política tendo em vista a potência de transformação contida nos coletivos de subjetividades portadoras de experiências comuns de violência e sofrimento. Fazendo uso do conceito de quilombo, em Beatriz Nascimento, buscaremos fundamentar o alargamento da ideia de política a partir de duas (...) configurações: a disputa por territórios e a conectividade entre saberes específicos e menores oriundos das lutas. Para tanto, cotejaremos o pensamento da autora com a filosofia contemporânea de Michel Foucault, Gilles Deleuze e Félix Guattari. Nossa hipótese é a de que o conceito de ação política demandaria um alargamento em sua formulação de modo a abranger as variadas e singulares formas de resistência cotidianas. (shrink)

Translated from the French, this book analyzes the paradoxes that fundamentally characterize Nietzsche’s philosophy and texts.

Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Este texto tem dois objetivos principais: apresentar o conceito de “lei natural” e aquilo que seria a sua expressão como “lei escrita” e, depois, reinterpretar este conceito a partir de uma perspectiva nietzschiana. Para alcançar este duplo objetivo urge, pois, em primeiro lugar, traçar, nas suas grandes linhas, as vicissitudes que atravessou a teoria da “lei natural” ao longo da tradição #losó#ca até a sua culminância naquelas correntes do direito natural, típicas dos tempos modernos. Convém também assinalar que este conceito (...) encerra no seu bojo, como derivações, as noções de necessidade, de #nalidade e providência. Eis por que, para interpretá-lo e criticá-lo, são utilizadas algumas intui- ções e análises de Nietzsche que, ao longo de sua obra, não cessa de se referir, direta ou indiretamente, a estas questões e, também, àquela de acaso. Não se trata, portanto, de simplesmente apresentar uma crítica de Nietzsche aos conceitos de “lei natural” e “lei escrita”, mas, principalmente, de examiná-los à luz de seu pensamento. (shrink)

Este artigo apresenta de modo ensaístico e embrionário, algumas reflexões acerca dos valores da previsão e do medo na filosofia jonasiana como valores necessários, ou ao menos desejáveis, para as ações governamentais diante de uma ameaça ao futuro da humanidade. Para isso, propomos um paralelo entre a realidade pandêmica atual e a filosofia de Hans Jonas, desenvolvendo em seguida sua concepção sobre tais valores. Nossas conclusões apontam de modo provocativo para aquilo que as futuras vítimas fatais da Covid-19 esperam hoje (...) do seu atual governo. Portanto, para que as pessoas comuns possam ter esperança sobre a manutenção das suas vidas e a volta de uma vida que antes era reconhecida como “normal”, é necessário que o nosso governo se oriente pelo temor diante das previsões potencialmente catastróficas. O presente trabalho resulta de um estudo da reentrada do ensino de Filosofia no currículo do ensino médio e sua repercussão no curso de graduação em Filosofia ofertado pela Universidade Estadual Vale do Acaraú, em Sobral-CE, cujo objetivo é provocar uma reflexão sobre o ensino de Filosofia na educação básica de nível médio e a intensidade desse impacto com o retorno da disciplina. Assim, analisamos se esse impacto aconteceu de forma positiva ou negativa para o curso de Filosofia da UVA. (...) En este breve comentario discuto algunos aspectos de la interpretación de la epistemología de Davidson que sugiere Willian Duica en su reciente libro. Luego de una presentación somera del libro me centro en tres asuntos centrales de la interpretación de Duica. En primer lugar, argumento que su lectura de la crítica de Davidson al dualismo esquema/contenido es muy restrictiva y deja abierta la posibilidad de un realismo directo empirista. En segundo lugar, argumento que en su lectura el propio Duica se (...) compromete inadvertidamente con un empirismo de este tipo y, de este modo, su interpretación entra en tensión con el coherentismo de Davidson. Finalmente, discuto algunos aspectos de la interpretación que hace Duica de la tesis davidsoniana de la triangulación. In this short comment I discuss some aspects of William Duica's interpretation of Davidson's epistemology in a recent book. After a brief review of the book, I focus on three central issues of Duica's interpretation. First, I argue that his reading of Davidson's criticism of the scheme/content dualism is too restrictive and leaves open the possibility of an empiricist direct realism. Second, I argue in his reading Duica inadvertently commits himself to an empiricism of this sort and, as a result, his interpretation is in tension with Davidson's own coherentism. Finally, I discuss some aspects of Duica's interpretation of Davidsonian triangulation. (shrink)

This article will contribute to a synthetic understanding of the factors that influence the subject’s experience with digital data, in the presence of a new kind of ‘materiality’ that is formed in the confluence of physical matter and Information and Communication Technologies that I call Material-ict. The aim is to offer society a critical and creative way to deal with the process in which the electronic and physical dimensions of reality merge and enhance the awareness of the paradigm change that (...) the Internet of Things is bringing to our experience. The article can contribute to the development of a new cognitive paradigm to challenge the current view that objects and environments are inanimate, and the shaping of a framework from which to reconsider interactions between people, social processes, things and environments in the society of knowledge. This framework offers insights into educative, technological developments and cultural programmes to integrate actants (actor–network theory) and citizens in the hybrid experience in which Internet, social processes and matter merge. The objective is to construct the first steps of an analysis framework to understand a few of the most important features that support the emergent model of representation that is impacting the subject’s experience with digital data. In order to construct this framework, this research is grounded in the intersection of art, media and experience. The main dimensions analysed in the article are (1) the merging of digital and analogue forms of experience; (2) new actors and forms of interaction; (3) forms of heterogeneous knowledge construction; (4) lively interfaces and animated environments; and (5) biotechnological convergence. The article will show how the outcome of this confluence is taking shape in different forms of (1) indexation, (2) simulation, (3) translation of matter into data and (4) ubiquitous hybrid networks (social+matter/nature). O presente trabalho tem como objetivo desenvolver uma comparação direta entre a ética da futurologia jonasiana e o neopragmatismo rortyano no que diz respeito ao tema da esperança na prática política. Este tema foi amplamente discutido por Ernest Bloch que propõe um princípio esperança capaz de ser o impulso basilar para que o homem transcenda o presente em direção ao futuro. Por sua vez, Richard Rorty aborda este tema enquanto esperança social, que diz respeito à manutenção do orgulho nacional capaz (...) de tornar-se condição necessária para o auto-aperfeiçoamento da sociedade. Porém, Hans Jonas trará a esse discurso da esperança uma perspectiva da ética da responsabilidade que prefere a prudência às previsões das ações a longo prazo enquanto promessa para um “mais” ou “melhor”. This article explores the construction of offences as ‘accidental’ in police-suspect interactions. The data comprise audio-recorded investigative interviews, which were analysed using conversation analysis. In these interviews, suspects often do not explicitly state the nature of their defence when answering police officers’ questions; instead, suspects’ defensive practices or techniques are embedded in the narrative accounts they give of what happened, thus exhibiting rather claiming their ‘innocence’. My focus here is on a particular type of defence, namely, one in which suspects (...) portray an event as having been ‘accidental’. I show that this defence of ‘accident’ is associated with several discourse features including: building a plausible and trivial context in which the untoward incident occurred, describing the untoward action or series of actions, using impersonal or agentless constructions, and representing the disproportionality between the putative victim’s reaction and the aggressor’s untoward conduct. The accountability of these descriptions, however, does not rely on one unique feature, but rather on suspects’ ability to combine these features in such a way that each establishes the grounds for others. The 'Gettier Problem' has been central to epistemology since 1963, when Edmund Gettier presented a powerful challenge to the standard analysis of knowledge. Now twenty-six leading philosophers examine the issues that arise from Gettier's challenge, setting the agenda for future work on the central problem of epistemology.

A cross-cultural survey experiment revealed a widespread tendency to rely on a rule’s letter over its spirit when deciding which acts violate the rule. This tendency’s strength varied markedly across (k = 15) field sites, owing to cultural variation in the impact of moral appraisals on judgments of rule violation. Compared to laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether, and consequently exhibited more pronounced textualist tendencies. Finally, we evaluated a plausible mechanism for (...) the emergence of textualism: In a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (Ntotal = 5495) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an easily identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers and judges. What are the roles of semantic and pragmatic processes in the interpretation of sentences in context? And how do we attain such interpretations when sentences are deemed indeterminate? Consider a sentence such as “Lisa began the book” which does not overtly express the activity that Lisa began doing with the book. Although it is believed that individuals compute a specified event to enrich the sentential representation – yielding, e.g., “began [reading] the book” – there is no evidence that a default (...) event meaning is attained. Moreover, if indeterminate sentences are enriched, it is not clear where the information required to generate enriched interpretations come from. Experiment 1 showed that, in isolation, there is no default interpretation for indeterminate sentences. The experiment also showed that biasing contexts constrain event interpretations and improve plausibility judgments, suggesting that event representations for indeterminate sentences are generated by context. In Experiment 2, participants heard biasing discourse contexts and later falsely recognized foil sentences containing the biased events at the same proportion and with the same confidence as the original indeterminate sentence. We suggest that indeterminate sentences trigger event-enriching inferences but only in sufficiently constraining contexts. We also suggest that indeterminate sentences create two memory traces, one for the proposition consistent with the denotational, compositional meaning, and another for the proposition that is enriched pragmatically over time. the objective of this article, making use of the theory of Hannah Arendt, is to show as the disruption with regimes of exception if it effected by means of transistions, of a vision of the politics as confrontation and violence for a model of the consensus and its counterpart was to occult the divergent ways with that the social subjetividades breach with the rational model, overshadowing the interpretations of the memory in the democratic normalization.

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

A discussão em torno da questão do trabalho infantil está hoje na ordem do dia dos principais países do mundo. O mercado mundial cada vez mais globalizado e competitivo pressiona sobretudo os países em desenvolvimento a erradicar esse tipo de trabalho. A inserção precoce da criança no mercado acaba comprometendo seu acesso a instâncias formativas que podem potencializar a sua conquista à cidadania. Este artigo pretende articular as categorias globalização, formação e cidadania com a questão do trabalho infantil, chamando atenção (...) para os prejuízos ou possibilidades de mudança dessa realidade, bem como para os interesses que estão por trás das diversas ações e campanhas voltadas à sua erradicação. On the basis of arguments showing that none of the most influential analyses of Moore’s paradox yields a successful resolution of the problem, a new analysis of it is offered. It is argued that, in attempting to render verdicts of either inconsistency or self-contradiction or self-refutation, those analyses have all failed to satisfactorily explain why a Moore-paradoxical proposition is such that it cannot be rationally believed. According to the proposed solution put forward here, a Moore-paradoxical proposition is one for which (...) the believer can have no non-overridden evidence. The arguments for this claim make use of some of Peter Klein’s views on epistemic defeasibility. It is further suggested that this proposal may have important meta-epistemological implications. This article develops a conceptual framework for regulating Artificial Intelligence (AI) that encompasses all stages of modern public policy-making, from the basics to a sustainable governance. Based on a vast systematic review of the literature on Artificial Intelligence Regulation (AIR) published between 2010 and 2020, a dispersed body of knowledge loosely centred around the “framework” concept was organised, described, and pictured for better understanding. The resulting integrative framework encapsulates 21 prior depictions of the policy-making process, aiming to achieve gold-standard societal (...) values, such as fairness, freedom and long-term sustainability. This challenge of integrating the AIR literature was matched by the identification of a structural common ground among different approaches. The AIR framework results from an effort to identify and later analytically deduce synthetic, and generic tool for a country-specific, stakeholder-aware analysis of AIR matters. Theories and principles as diverse as Agile and Ethics were combined in the “AIR framework”, which provides a conceptual lens for societies to think collectively and make informed policy decisions related to what, when, and how the uses and applications of AI should be regulated. Moreover, the AIR framework serves as a theoretically sound starting point for endeavours related to AI regulation, from legislation to research and development. As we know, the (potential) impacts of AI on society are immense, and therefore the discourses, social negotiations, and applications of this technology should be guided by common grounds based on contemporary governance techniques, and social values legitimated via dialogue and scientific research.
